Important Notice: Travel Advisory & Consultation Service Model
Shark Travel (SHARK TRAVEL LLP / Shark Travel LLC) operates strictly as an independent travel advisory, itinerary curation, and logistics consultation firm. We DO NOT directly issue, operate, inventory, or fulfill airline tickets, hotel stays, bus seats, or train tickets.
All payments made to Shark Travel represent professional advisory, research, fare comparison, and logistics consultation fees ("Advisory & Service Fees"). Airline fares and real-time flight availability data displayed on our portal are powered via third-party API integrations (including Duffel Technology Ltd) for informational and advisory comparison purposes.
1. Legal Agreement & Corporate Identity
These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("Client", "User", "You") and Shark Travel (operating through Shark Travel LLC incorporated in Wyoming, USA, and SHARK TRAVEL LLP, registered in Chandigarh, India with GSTIN: 04AFYFS5855A1ZN).
By accessing our website (https://sharktravel.us), interacting with our travel advisors, or issuing payment for consultation services, you explicitly acknowledge that you have read, understood, and agreed to be bound by every provision of this Agreement.
2. Nature of Services & Third-Party API Integrations
Shark Travel offers professional travel advisory, itinerary optimization, route planning, fare monitoring, and carrier selection services. Specifically:
- Advisory Role: We analyze traveler requirements and recommend optimal flight routes, train timings, bus schedules, and hotel accommodations based on budget, layover times, and carrier performance.
- Duffel & Third-Party API Data: Real-time flight search, fare availability, and schedule data displayed on our platform are sourced directly from third-party aggregators and API technology providers, including Duffel Technology Ltd. Fares, seat inventory, and baggage allowances shown are dynamic and subject to instant fluctuation by underlying airlines.
- No Direct Carrier Operations: Shark Travel does not own, lease, control, or operate aircraft, trains, buses, or hotel properties. When a client decides to proceed with a recommended itinerary, the final booking contract for transportation/lodging remains exclusively between the client and the respective end-supplier (airline, rail operator, bus line, hotel provider).
3. Payment Link Workflow & Zero Card Collection Guarantee
Shark Travel maintains a strict payment security protocol. Our representatives, advisors, and staff NEVER ask for, collect, or accept credit/debit card numbers, CVVs, PINs, or banking passwords over the phone, email, WhatsApp, or chat messages.
- Exclusive Payment Links: All payments for travel consultation and advisory fees are completed solely via official, secure payment links sent directly to the client, leading to our encrypted payment page at https://sharktravel.us/pay.
- Hosted Checkout Platform: When you open our payment link, your card credentials are entered directly into an embedded, PCI-DSS Level 1 certified hosted payment form provided by our licensed payment partners (PayGlocal / Xpay). Your card information is transmitted directly to payment processors and never touches, enters, or stores on Shark Travel servers.
- Earned Upon Service Delivery: Consultation fees are earned immediately upon the delivery of travel recommendations, itinerary quotes, or booking assistance, and are completely non-refundable once consultation work has commenced.
- Authorization: By submitting payment through our official secure link, you authorize Shark Travel to process the agreed consultation fee and represent that you are an authorized user of the payment instrument.
4. End-Supplier Carrier Rules, Cancellations & Schedule Changes
All flight, hotel, train, and bus services recommended by Shark Travel are governed by the independent tariffs, conditions of carriage, and refund policies of the respective travel supplier.
- Schedule Alterations & Delays: Airlines, rail companies, and bus operators reserve the right to alter schedules, cancel routes, or delay departures due to weather, air traffic, mechanical issues, or regulatory directives. Shark Travel assumes ZERO liability for carrier-initiated schedule changes, cancellations, missed connections, or default.
- Baggage & Extra Charges: Suppliers may impose additional fees for checked baggage, seat selection, meals, or airport check-in. Clients are solely responsible for reviewing carrier rules prior to departure.
- Travel Documentation: Clients are exclusively responsible for obtaining valid passports, visas, transit permits, health/vaccination certifications, and re-entry authorizations required for their destination. Shark Travel is not liable for boarding denials resulting from insufficient documentation.
5. Complete Limitation of Liability & Hold Harmless
To the maximum extent permitted by applicable law in Wyoming (USA) and India:
(A) Maximum Damages Cap: Under no circumstances shall Shark Travel, its partners, officers, employees, or legal entities (Shark Travel LLC / SHARK TRAVEL LLP) be liable for any indirect, incidental, consequential, special, or punitive damages (including lost profits, lost luggage, missed events, personal injury, or hotel accommodation costs) arising out of travel recommendations or API price displays.
(B) Liability Ceiling: The aggregate liability of Shark Travel for any claim arising under these Terms shall be strictly capped at the total amount of professional consultation fees paid by the client to Shark Travel for that specific transaction.
6. Chargeback Protection & Dispute Resolution SLA
We are committed to fair and transparent client support.
- Mandatory Pre-Dispute Notice: Prior to filing any payment dispute or chargeback with your bank or credit card issuer, you agree to contact Shark Travel at info@sharktravel.us or (877) 216-2220 to resolve the matter. Our compliance team acknowledges inquiries within 24 hours.
- Fraudulent Chargebacks: Unwarranted chargebacks initiated after receiving travel consultation or advisory quotes will be vigorously defended using PNR logs, email records, IP stamps, and signed agreement receipts, and may be referred to credit reporting agencies and legal collection counsel in the US/India.
7. Governing Law & Corporate Contact
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, and the applicable laws of India, without regard to conflict of law principles.
